These terms of use (“Terms”) govern your use of the Video Network website and services (the “Platform”), operated by Media Partnership Ltd trading as Video Network (“we”, “us”, “our”). By creating an account, submitting a listing, or otherwise using the Platform you agree to these Terms. If you do not agree, please do not use the Platform.
If you use the Platform as a consumer, nothing in these Terms affects your statutory rights. If you list on the Platform as a videographer, you are using it in the course of a business.
1. About us
Video Network is an online directory that connects clients with videographers. We are a brand of Media Partnership Ltd, a company registered in England & Wales (company number 05594791), with its registered office at Northern Design Centre, Gateshead, NE8 3DF.
2. Our role
Video Network is a directory. It helps clients discover videographers and contact them directly. We are not a party to any agreement, booking or contract made between a client and a videographer, and we are not an agent, employment agency, broker or introducer for either side. We do not employ, represent, endorse or guarantee any videographer or client, and we are not responsible for the quality, safety, legality, timing or delivery of any services arranged through the Platform. Any agreement you enter into is strictly between you and the other party. We do not take a commission on work arranged through the Platform.
We do not vet, verify or background-check videographers or clients, and a listing on the Platform is not a recommendation. Before you book, pay or share anything with another user, please do your own due diligence: watch their showreel, ask for references or examples of past work, agree the scope, price and timings in writing, and check they hold the insurance and permissions your project needs. Any dispute, refund or claim for compensation is a matter between you and the other party. We will not act as a mediator, guarantor or insurer, and we will not compensate you for the acts or omissions of another user.
We do not guarantee that any listing will receive views, enquiries or bookings, or that any enquiry will lead to work.
3. Your account
You must be at least 18 years old to create an account or submit a listing. You agree to provide accurate, current information and to keep it up to date, to keep your login details secure, and to use the Platform lawfully and in line with these Terms. You are responsible for all activity that takes place under your account. You may hold one account, and each videographer may have one listing, unless we agree otherwise.
Parts of the Platform may be offered on an invitation, waiting-list or beta basis. We may change, limit or withdraw features while the Platform develops, and we will try to give reasonable notice of changes that affect a paid feature.
4. Videographer listings
If you list on the Platform, you are responsible for the accuracy of your listing, for holding any licences, insurance and permissions your work requires, and for delivering the services you agree with clients. You confirm that you have the right to use everything in your listing, including your showreel and images, and that you have any releases or permissions needed from the people, locations and clients that appear in them.
Listings may not contain web addresses, email addresses, phone numbers or other contact details, or links of any kind, except in the dedicated website and phone number fields we provide, which are displayed only while a listing is Pro. This keeps enquiries in one place and protects users from unsafe links. Once a client has messaged you, you are free to share your contact details in the conversation.
You must not post content that is misleading, unlawful, infringing, discriminatory or that you do not have the right to use. We may edit, decline, suspend or remove any listing at our discretion, and we may correct formatting or remove prohibited content without notice.
5. Enquiries and messaging
The Platform lets clients and videographers message one another. You agree to use messaging respectfully and only for genuine enquiries about video work. Spam, harassment, unsolicited marketing, recruiting for other platforms and automated messaging are not permitted. We may apply limits to protect users, including limits on the number of new conversations a member can start in a given period, and we may monitor messages to keep the Platform safe and to enforce these Terms.
Messages may contain links to websites outside the Platform. We do not control, check or endorse external sites and cannot vouch for their safety or content. Please take care before clicking a link, downloading a file or sharing personal or payment details, and never pay a deposit to anyone you have not verified. Anything that happens on another website, or otherwise off the Platform, is outside our control and at your own risk.
We send email notifications about new messages. You can turn these off in your account settings; if you do, you are responsible for logging in to check your messages, and we are not responsible for any enquiry you miss.
6. Fees and paid features
Free features. Searching, viewing listings and contacting videographers is free for clients. A basic listing is free for videographers.
Video Network Pro. Pro is a paid placement for a videographer listing. For the Pro period your listing appears above non-Pro listings in search results within the searcher’s chosen radius, is visually highlighted, carries the Pro badge on your listing and in messages, and can show a “Visit website” button and a click-to-reveal phone number so clients can contact you directly. Where more than one Pro listing matches a search, Pro listings are shown in a random order that changes from visit to visit; no Pro member is given priority over another. Pro gives your listing greater prominence but does not guarantee any number of views, enquiries or bookings.
Period. Pro runs for the period agreed when it is purchased, included with another purchase, or awarded in a promotion or giveaway. A purchased Pro placement is normally 12 months; promotional placements may be shorter and run for the period stated in the offer. The period starts on the day Pro is applied to your published listing. If you do not yet have a published listing when Pro is purchased or awarded, it is held for you and starts when your listing is published. Pro applies to one listing and cannot be transferred, shared or resold.
Pro included with a course. Where Pro is included with a course or other product you buy from us, the course or product is governed by the terms shown at the point of purchase, and the Pro placement is governed by these Terms. Course access is personal to the purchaser and may not be shared. The Pro period included with a purchase is as stated at the time of purchase and starts as described above.
Prices and renewal. Prices are shown at the point of purchase, in the currency shown, and include any applicable taxes unless stated otherwise. Pro does not renew automatically unless the purchase page says so. We will tell you before your Pro period ends and you may renew at the price then offered. We may change prices for future periods at any time.
Cancellation and refunds. If you buy as a consumer, you may have a legal right to cancel within 14 days of purchase. Because Pro placement starts as soon as it is applied, by asking us to apply it within that period you agree that if you then cancel we may deduct a proportionate amount for the days of placement already provided. Where a purchase includes digital course content, your right to cancel that content ends once you start accessing it with your agreement. Otherwise, fees are non-refundable except where the law requires, or where we permanently withdraw Pro or remove your listing other than for a breach of these Terms, in which case we will refund the unused part of the period on a pro-rata basis. No refund is due if your listing or account is suspended or removed for breach.
Promotions. We may offer free or discounted Pro placement, founding-member offers or other promotions. Promotional placement is subject to these Terms and to any conditions stated in the offer, and may be withdrawn if the conditions are not met.
7. Content and intellectual property
You retain ownership of the content you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, adapt (for formatting and size) and promote your content in connection with operating and marketing the Platform, including in search results, on social media and in our own marketing, for as long as your listing is live and for a reasonable period afterwards. You are responsible for your content and confirm that it does not infringe anyone’s rights. If you send us feedback or suggestions, we may use them without obligation to you.
All Platform branding, design, software, databases and text remain our property or that of our licensors and may not be copied, scraped or reused without our written permission. Listing data may be viewed for the purpose of finding and contacting a videographer only.
8. Acceptable use
You must not misuse the Platform. In particular you must not: attempt to gain unauthorised access to any part of it; scrape, harvest or bulk-download data; use bots or automated tools; upload malicious code or links; create false or duplicate accounts or listings; impersonate anyone or misrepresent your identity, qualifications, availability or Pro status; post other people’s personal information without permission; use messaging to recruit for or promote other platforms or services; harass, threaten or discriminate against anyone; attempt to get around any limit we apply; or use the Platform for any unlawful purpose. These standards apply across all Video Network services, including our community groups.
9. Privacy
We handle personal data as described in our Privacy Policy and use cookies as described in our Cookies Policy. Messages sent through the Platform are stored on our systems and may be reviewed where necessary to keep the Platform safe, investigate a complaint or comply with the law. When you list on the Platform, the information in your listing is public.
10. Third-party services and links
The Platform uses third-party services, including mapping and location services, payment processors and the platform that hosts our courses, and may contain links to third-party websites. Those services and sites have their own terms and privacy policies, and we are not responsible for them, for their availability, or for anything you do on them.
11. Disclaimers and liability
The Platform is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, secure or error-free, that any information on it is accurate or complete, or that any videographer or client will meet your requirements.
To the fullest extent permitted by law, we exclude all liability for any loss or damage arising from your use of the Platform or from any dealings between clients and videographers. In particular, and without limiting the above, we are not liable for the conduct of any user; for any services, bookings or payments agreed between users; for the accuracy of any listing; or for the content or security of any third-party website linked from the Platform. The Platform is a directory only, and the decision to work with any videographer or client is yours alone.
We are not liable for any indirect or consequential loss, or for loss of profit, business, revenue, contracts, goodwill or data, even if foreseeable. Where liability cannot be excluded, our total liability to you for all claims arising in any 12-month period is limited to the greater of the fees you paid us in that period and £100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited by law, and nothing affects the statutory rights of consumers.
12. Your responsibility to us
If you use the Platform in the course of a business, you agree to compensate us for any loss, claim or cost (including reasonable legal fees) we suffer as a result of your listing or content, the services you provide or fail to provide, or your breach of these Terms or the law.
13. Suspension and termination
We may suspend or remove any account, listing or message that breaches these Terms, that we reasonably believe poses a risk to other users or to the Platform, or that attracts credible complaints. Where practicable we will tell you why. You may close your account at any time from your account settings or by contacting us; your listing will then be removed. Any Pro period that remains is forfeited if we act because of your breach, and otherwise is handled as described in section 6. Sections 7, 11, 12, 15 and 16 continue to apply after your account ends.
Video Network is one community across all our services, including this Platform, our courses, our events and our members’ groups (including the Video Network Facebook community). Each has its own rules, which are published where that service is provided and may change from time to time. If you seriously or repeatedly breach the rules of any of them, or behave in a way that we reasonably consider harmful to other members or to our reputation, we may suspend or remove your account and listing on this Platform, and any remaining Pro period is forfeited as described in section 6.
14. Changes to these Terms
We may update these Terms from time to time, for example to reflect new features, legal requirements or changes to how the Platform works. The current version is always posted on this page with its “last updated” date. If we make a material change we will give reasonable notice, normally by email to registered members or by a notice on the Platform. Your continued use of the Platform after a change takes effect means you accept the updated Terms; if you do not accept them, you should stop using the Platform. If a change materially reduces a paid feature you have already bought, you may cancel that feature and we will refund the unused part of the period on a pro-rata basis.
15. General
These Terms, together with our Privacy Policy and Cookies Policy and any terms shown when you make a purchase, are the whole agreement between you and us about the Platform. If any part of these Terms is found to be invalid, the rest continues to apply. If we do not enforce a right immediately, we may still enforce it later. You may not transfer your rights under these Terms to anyone else; we may transfer ours to a successor business. We are not responsible for delays or failures caused by events outside our reasonable control. Nobody other than you and us has any rights under these Terms. Notices to you may be sent to the email address on your account.
16. Governing law
These Terms are governed by the laws of England & Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England & Wales. If you are a consumer living elsewhere, you may also be entitled to the protection of the mandatory consumer laws of your own country and to bring proceedings there. If you have a complaint, please contact us first and we will try to resolve it with you.
